While completing a workout at a fitness facility, Bobby suffered a heart attack. Two employees, hearing patrons shouting, ran to help. 

One of the employees who was certified in CPR saw Bobby lying on his back, bleeding from a cut on his head. Bobby was also shaking from convulsions. When the employee knelt by Bobby’s side to assess his condition, the employee felt a faint pulse, which to him indicated a heartbeat. He also noticed Bobby’s face was red and interpreted that Bobby had an oxygen supply. The employee thought that Bobby was suffering from a stroke or seizure and decided not to perform CPR, since he thought that this would make the situation worse. The employee told the EMTs that Bobby had just started turning blue when they arrived. 

Approximately 5 to 6 minutes passed from the time Bobby fell until the EMTs arrived. The EMTs found Bobby not breathing and without a pulse. After performing CPR and using a defibrillator to shock Bobby’s heart, the EMTs took him to the hospital where Bobby was unfortunately pronounced dead.  

Bobby’s family filed a wrongful death lawsuit against the facility, claiming that the facility breached its duty to provide the appropriate care during a medical emergency since the employees failed to perform CPR or use an AED. Additionally, they claimed that organization did not properly train its employees to handle medical emergencies.
