Workers’ Compensation Claims and Cost Management Plan Detailed Instructions and Hypothetical Scenario The purpose of the Workers’ Compensation Claims and Cost Management Plan to apply learning from the course to draft – from scratch – a policy (aka program) for an employer that guides its management of costs associated with workers’ compensation claims. must apply critical thinking in this assignment, as the practice of safety often requires these documents to be customized to fit the needs of a particular organization. (No template is provided for a reason.) While you can conduct independent research and evaluate other policies/programs found on the internet and/or library, the policy must be written and tailored for the employer below. The central focus of the policy/program is to control the costs through an early return-to-work system; in other words, a “light and modified duty” policy/program. In essence, this assignment is frequently called a “Light – Modified Duty Program.” Students should keep in mind this assignment is NOT a research paper. Claims and Cost Management Plan should, at minimum, contain the following key elements as covered in the associated weekly lecture video, and PowerPoint slides: • Policy Statement o Commitment o Purpose o Scope (work related injuries only?) o Light/modified duty accommodation duration • Responsibilities • Reference / integration with injury reporting – medical treatment (pre-requisite) • Job descriptions w/ physical/functional requirements • Process for medical provider interaction • Requirements for Communicating Restrictions (medical provider – injured worker – supervisor – safety- HR, etc.) • Inventory of light-duty jobs and light-duty descriptions • Light/Modified Duty Compensation policy • Periodic progress review: o Employees on TTD o Employees currently working light / mod duty • Forms should use the employer scenario below, a business that should be familiar to most people, as the backdrop for this assignment. In other words, your writing you plan/program for the following employer below. Students should think about this familiar type of business, and can be creative when considering light-modified duty opportunities. The Employer Get-R-Done, Inc., (the “Company”), is a leading mowing and landscape business. The Company has twenty-seven different offices in three states: Kentucky, Indiana and Ohio. The offices are evenly dispersed throughout the geographical, urban areas of each state. Each office services an approximate 75-mile radius. There are approximately 20 employees at each office location. The bulk of the Company’s business involves mowing grass and trimming weeds. The company does, however, apply lawn treatments, including regulated pesticides and herbicides. Only certain employees from each office are authorized to apply regulated pesticides and herbicides, and each such employee must obtain/maintain proper licenses within the particular state they operate. The company also does landscaping. Landscaping operations largely consist of removing and planting shrubs and small trees (the company does not engage in tree felling or arborist work), planting flowers, and spreading mulch. On occasions though, the company will install simple, residential and commercial lawn irrigation systems. (This includes the installation of electrical timers, piping, and in some cases pumps.) In the winter, trucks are equipped with snow plow blades, and employees apply granular, ice- melt materials as well as liquefied pre-treatment. When inclement weather is in full swing, employees may have to work long shifts. Obviously, the offices in Northern Ohio and Northern Indiana do more snow removal work than most. The Company has a fleet of heavy duty pickup trucks; some equipped with dump beds. Each location also has a heavy duty, straight truck that is equipped with a large liquid tank and commercial spraying equipment for the application of pesticides, herbicides and liquid fertilizer. Drivers of the heavy duty liquid tank trucks must possess a valid, Class B CDL license. All other employees driving company vehicles must at least maintain a DOT physical. Only more experienced employees (those who have been working with the company more than six- months) are permitted to drive company vehicles. The company also owns trailers to transport lawn mowing equipment which largely consists of industrial, zero-turn riding mowers; gas powered weed trimmers; and gas powered, shoulder harness leaf blowers. The company stores herbicides, pesticides and liquid fertilizer in bulk quantities at each office, but there is not enough in storage to trigger OSHA’s PSM standard. Each office has a maintenance shop where all equipment, including motor-vehicles, is serviced and maintained. For mowers and other powered lawn care equipment, the company provides a full range of service and repair. A frequent task in the shop involves sharpening mower blades. Some sharpening is done with a sharpening machine, however, some unique blades require the shop technician to sharpen an individual blade by hand with a bench grinder. The company only performs light preventive maintenance on motor-vehicles; i.e., oil changes and lubrication. Each office operates like a typical office and has computer, filing and other administrative tasks. Occasionally, the company’s office needs increase and they bring in temporary workers from local agencies to help with these needs. Git-R-Done has never had a workers’ compensation claims and cost management plan (light-
